These terms and conditions administer your use of Archiol Competitions and provide you with all the necessary information about its services, we have drafted the terms of use, so that you will know the rules that govern your relationship with Archiol Competitions and its subsidiaries and affiliates (hereinafter collectively referred to as “Archiol Competitions”, “We”, “Us” or “Our”) and set forth the terms and conditions under which Archiol Competitions makes available its website archiolcompetitions.com (the“Website”), and/or mobile application (the “Application”), collectively known as “Services”, to each person assessing or using the Services.
These Terms do indeed form a legally binding Agreement between you and Archiol Competitions. You agree to these terms when you use our services or even if you decide to simply browse through our website. So please read them carefully.
The terms “you,” “user” and “users” refers to all individuals and other persons who access or use our services, including, without limitation, any companies, organizations, or other legal entities that register accounts or otherwise access or use the services through their respective employees, agents or representatives.
You must agree to the complete terms and conditions, which means that only part agreement is not allowed and it will be considered the same as non-agreement.
You will be considered to have fully understood and accepted the terms and conditions if you check the box mentioning “I agree to the Terms and Conditions” before registration.
By using this website (and the associated websites) you agree to abide by the terms and conditions as specified, if you do not agree to these terms and conditions, do not use the site or register to any competition organised by Archiol Competitions.
OWNERSHIP
Archiol Competitions reserves the right to change, transfer ownership, release, withdraw or disband this website at any time without warning or liability. It is your responsibility to regularly check, if any changes have been made to these terms and conditions.
SITE USE
You agree that you will only use our website in a way, which is consistent with our terms and conditions. We reserve the right to modify or withdraw this site at any time without liability. All uses of this website (www.archiolcompetitions.com) and all material provided herein must coincide with the Terms of Use. The Website and content owned or controlled by Archiol Competitions may not be copied, reproduced, published, broadcast, rewritten or redistributed without permission, except where expressly permitted by these Terms and Conditions or applicable law.
You may not attempt to gain unauthorized access to any portion or feature of the Site, or any other systems or networks connected to the website. You may not attempt to obtain any materials, documents or information through any means not purposely made available through the Site.
You may not probe, scan or test the vulnerability of the Site or any network connected to the Site, nor shall breach the security or authentication measures on the website or you will be liable for any loss incurred by Archiol Competitions.
All works submitted to Archiol Competitions including but not limited to for submission in a competition or for publication, must be submitted in agreement with the Archiol Competitions Terms of Use.
By submitting any work, project, design, drawing, image, photograph, rendering, animation, text, description, presentation, document or other material (“Submission”) to Archiol Competitions, the Participant grants Archiol Competitions a non-exclusive, worldwide, royalty-free licence to reproduce, publish, distribute, communicate to the public, display, archive, format, edit, crop, resize, translate, adapt and otherwise use the Submission, in whole or in part, in connection with Archiol Competitions and its editorial, educational, promotional and commercial activities.
The licence granted under these Terms expressly includes the right to include the Submission in websites, social media, exhibitions, competitions, magazines, books, catalogues, journals, annual publications, collections, compilations, e-books, PDFs, digital publications, downloadable publications and other physical or electronic publications.
Archiol Competitions may create, publish, distribute, market, promote, license and sell publications containing Submissions, whether such publications are offered individually, as part of a collection, through a subscription, or together with other submissions or materials. The Participant acknowledges that such publications may be offered free of charge or for commercial sale.
The licence includes the right to use reasonable extracts, images, previews and excerpts from a Submission for advertising, marketing and promotion of the relevant publication and Archiol Competitions.
Archiol Competitions may use publishers, printers, distributors, hosting providers, digital platforms, retailers, marketing partners and other service providers to exercise the rights granted under these Terms.
The Participant retains ownership of the copyright and other intellectual property rights in the Submission. Nothing in these Terms transfers ownership of the Participant’s copyright to Archiol Competitions.
DISCLAIMER AND LIMITATION OF LIABILITY
Archiol Competitions – the site, its content, related media and any competitions are delivered on an “as-is” and “as-available” basis. In no event shall Archiol Competitions be liable for special, direct, indirect, and consequential or incidental damages whatsoever, whether in action, negligence or other tort arising out of or in connection with the users of the service or the content made available on the website.
Archiol Competitions cannot ensure that any files or other data you download from the site will be free of viruses or contamination or destructive features and will not be liable for any damages arising out of the same.
Archiol Competitions disclaims all warranties, express or implied, in relation to the site, competition or content of the site including any warranties of accuracy, non-infringement, merchantability and fitness for a particular purpose.
Archiol Competitions disclaims any and all liability for the acts, omissions and conduct of any third parties in connection with or related to your use of the site. If you do not agree to be bound by the agreement, you may not access or use the services in any form.
Archiol Competitions reserves the right to modify, update, add or remove content relating to its Competitions or Services where reasonably necessary for operational, editorial, legal or business purposes.
The Participant represents and warrants that the Submission is original to the Participant or that the Participant has obtained all rights, licences and permissions necessary to submit the Submission to Archiol Competitions and to grant Archiol Competitions the rights and licence set out in these Terms.
Where a Submission contains photographs, illustrations, artwork, text, graphics, fonts, music, video, renders, images or other materials created or owned by third parties, the Participant represents and warrants that all necessary permissions have been obtained for Archiol Competitions to use those materials in accordance with these Terms.
The Participant shall be responsible for any third-party claim arising from a failure to obtain the required rights or permissions.
The Participant agrees to indemnify and hold harmless Archiol Competitions, its owners, officers, employees, agents, affiliates, service providers and representatives from claims, losses, damages, liabilities, costs and reasonable legal expenses arising from or relating to:
(a) any breach by the Participant of these Terms;
(b) any allegation that a Submission infringes or misappropriates the copyright, trademark, design rights, privacy rights, publicity rights or other rights of a third party; or
(c) any allegation arising from the Participant’s failure to obtain the rights, licences or permissions required for the Submission.
The participants also acknowledges and agrees and therefore covenants not to sue or make any claim against any party related to any participant’s submission or any individual participation or involvement in the Competition in any way whatsoever, or any use thereof, and therefore:
Under no circumstances shall or can the Participant be entitled to any award for any loss or any damages, which include attorneys’ fees.
Any dispute, claim and legal action arising from or connected with this Competition, or any prizes awarded or potentially awarded therein, shall be resolved without resort to any form of legal action or class action.
Should a participant choose to bring a claim against Archiol Competitions or its affiliates or agents the participant shall pay the Archiol Competitions or any party’s reasonable attorneys’ fees and its legal costs arising from the claim should it fail.
Nothing herein will constitute a waiver of the participants’ legal rights or any rights any party may have to take against the participant.
Archiol Competitions shall not be liable for any law suit or claim against any of its judges or selector panel emanating from their professional conduct or otherwise.
Unless clearly stated, all Competitions are design concept only and do not imply in a way, an intention for the proposals to be constructed or built.
CHANGES
Archiol Competitions may amend these Terms and Conditions from time to time. Updated Terms will be published on the Website. Changes that materially affect rights or obligations relating to future Submissions will apply to Submissions made after the updated Terms become effective, unless otherwise permitted by applicable law. The version of these Terms accepted by a Participant at the time of Submission will continue to govern the rights and obligations arising from that Submission, unless the Participant expressly agrees to a subsequent amendment.It is your responsibility to regularly check, if any changes have been made to these terms and conditions.
INTELLECTUAL PROPERTY DISCLOSURE
All the users of the website and the content related to the website owned by Archiol Competitions should not replicate, rework, repeat, regenerate, circulate or use any of the content available on the website and other media pages. The Logo, content and other visual media is created by Archiol Competitions and is protected with the Copyright Laws.
PRIVACY POLICY
Archiol Competitions is committed to protecting the privacy of all its users. All information collected on our site is only used to process and administer your competition submission (In accordance to the competitions terms & conditions) and to provide the users a more personalized experience on the site.
COPYRIGHT PROTECTION
All registered trademarks, symbols or words are owned, protected and property of the respective trademarks of their owners.
INFORMATION WE COLLECT
We collect either directly from you when you register with our site or through cookies which are information that are stored by your browser on your computer.
Cookies are small text files that identify your computer to our server and enable us to enhance your visit and experience with us. These cookies record information on viewed pages or adverts, frequency of visited pages and general navigation of our site. These cookies in no way allow us access to your computer and do not store any personal or payment details.
The personal information collected is mainly used for Competition submission administration and processing (In accordance to the Competitions terms & conditions) We may sometimes also monitor site usage, shopping and traffic patterns to improve the functionality of the site, products and services.
Details collected upon registration will include your name, email address, postal address and telephone number (where necessary), and by registering with Archiol competitions you agree to the terms and conditions. Where a Participant has provided the applicable consent, their contact details may be used to send information about future Competitions, publications, products or promotions, in accordance with the Privacy Policy and applicable law.
DATA PROTECTION
Archiol competitions will hold and use your personal data strictly in accordance with Indian data protection legislation.
RIGHTS RESERVED
The Participant retains ownership of the copyright and other intellectual property rights in the Submission, except for the rights expressly licensed to Archiol Competitions under these Terms.
By submitting a Submission, the Participant grants Archiol Competitions the licence described in these Terms. The grant of this licence does not constitute a transfer or assignment of ownership of the Participant’s copyright.
The Participant is solely responsible for ensuring that the Submission and all materials contained within it may lawfully be submitted and used in accordance with these Terms. The Participant shall be responsible for claims, costs and liabilities arising from any infringement or unauthorized use contained in the Submission.
WITHDRAWAL, UNREGISTRATION AND PERSONAL DATA
A Participant may request withdrawal or unregistration in accordance with the applicable Competition rules. A request concerning the Participant’s personal information will be handled in accordance with Archiol Competitions’ Privacy Policy and applicable data protection law.
Withdrawal or unregistration of a Participant or Submission does not automatically revoke, cancel or otherwise affect any copyright licence previously granted to Archiol Competitions under these Terms.
Where a Submission has already been published, reproduced, distributed, included in a book, e-book, PDF, catalogue, magazine, digital publication, printed publication or other material before the effective date of withdrawal, Archiol Competitions may continue to distribute, display, sell, promote and archive that existing publication or material.
Where a Submission has already been selected, prepared or scheduled for publication before withdrawal, Archiol Competitions may complete and publish the relevant publication where permitted by the licence granted under these Terms.
Nothing in this clause affects any rights that cannot lawfully be excluded or restricted under applicable law.
NOTIFICATION OF CHANGES
Any changes to our privacy policy or how we collect and use your personal information, will be reflected on the site and registered users will be informed and given the opportunity to disagree or agree with this change.
SECURITY POLICY
Archiol Competitions is aware of how important it is to able to browse safely and securely which is why all sensitive information is collected and process through a secure system. When we require you to enter sensitive information such as payment card details, you will be taken to a secure system and you should see the unbroken key or locked padlock icon at the bottom of your browser and also ‘https’ at the address bar, which indicates a secure system. However, Archiol Competitions does not undertake to cover any liability arising out the use of the secured payment gateway.
UNSUBSCRIBE
Users may unsubscribe from marketing emails or future promotional communications at any time by using the applicable unsubscribe mechanism.
Withdrawal or unregistration from a Competition does not automatically revoke any publication or copyright licence previously granted to Archiol Competitions.
Where a Submission has already been published or incorporated into a publication or other material before withdrawal, Archiol Competitions may continue to distribute, sell, display, promote and archive that existing publication or material.
No refund shall be provided solely as a result of withdrawal or unregistration, except where otherwise required by applicable law or expressly provided in the applicable Competition rules.
METHODS OF PAYMENT
All payments are accepted in INR via Razorpay. Non-Indian participants also have the option to pay in USD via PayPal. We accept the following credit and debit card payment methods for your submission:

However, the mode of payments may be added or deleted in the future without prior notice.
SPECIAL PROMOTIONS AND COMPETITIONS
Archiol Competitions reserves the right to alter the content, associated dates, awards and publication of any promotion or competition at any time. Further, Archiol Competitions reserves the right to cancel, discontinue or terminate any competition or promotion.
LIMITATION OF LIABILITY
Archiol competitions disclaim any and all warranties or association of any kind (expressed or implied) in relation to the Competitions or product or services on this site.
GENERAL INDEMNITY
You accept to completely indemnify Archiol Competitions and its members and officers from and against all legal claims including but not limited to liabilities, damages, losses, or any costs and expenses and any legal fees that arise out of the use of this website or from participation in a competition.
GOVERNING LAW
The competition and these terms and conditions will be governed by Indian law.

COMPETITION TERMS & CONDITIONS
The above Terms of Use also apply to submissions of a competition. Any participant agrees to abide by the rules and terms for each individual competition as outlined in the competition summary.
Archiol Competitions functions as a platform for design competitions. These competitions, unless otherwise stated are open idea competitions and in no way intend to be realized. Stated concepts have no intention to degrade current conditions or areas. Competitions held by Archiol Competitions function from an ideas standpoint and do not directly relate to any organization, neighborhood, city or individual stated on the website, brief, or any other data associated with Archiol Competitions. Competitions are not meant to undermine or in any way influence the idealistically used property or the organization, individual, or related party that owns said property.
Archiol Competitions does not intend to replace, better, or have any realistic influence on organization, companies, or any party that is related to the materialization of our competitions.
Archiol Competitions holds the right to change or adapt the rules and regulations of any promotion or competition at any time. It is the responsibility of the participants to check for regular updates, notification and changes to competition rules, regulations and terms. Participants in any competition agree to the terms and conditions of this site and each competition when they register. Registration is limited to the stated number of individuals for each competition, any team that submits work coming from more than the stated maximum is subject to disqualification at any time, including withholding rewards and withholding publication.
Registrants may not alter, modify or remove team credentials after team registration has been completed. Violation of team submission is subject to disqualification at any time, including withholding rewards and withholding publication. Any team or individual that violates the rules or these Terms and Conditions during or after a Competition may have their rewards, eligibility, publication selection or other Competition outcome revoked at any time, subject to any publication rights already exercised by Archiol Competitions and applicable law. Any team that does not follow the submission guidelines for each competition may be subject to disqualification.
Archiol Competitions does not accept any changes made to any proposal once submitted by the participant and if made would not be accounted to be valid. The users and the participants are requested to submit their works or proposals only once they have finalized their submission. By submitting a proposal, Participants represent that, to the best of their knowledge, the Submission is their original work or that they have obtained all necessary rights and permissions to submit and use any third-party material contained in it. Participants must not knowingly submit copied, plagiarised or unlawfully reproduced material.
By placing personal names or any means to identify who a team is on a submission, other than the given identification number, a team may be subject to disqualification.
Winning teams must provide a valid method to accept monetary rewards within two weeks of the award being presented. Failure to receive monetary awards in timely manner may result in the award being revoked.
Competition participants will receive their individual or team confirmation number after completing registration. This number is used for identification purposes throughout the jury voting process. Any submission that does not include this confirmation number as stated or incorrectly may be subject to disqualification.
Archiol Competitions holds the right to change competition dates as it sees fit at any time as well as revoke any promotion or competition without further notice.
Archiol Competitions holds the right to adjust deadlines throughout the duration of a competition, as well as the right to disqualify late submissions. In the event of a temporary deadline extension, Archiol Competitions holds the right to accept or accept and penalize late submissions by a level determined by the organizers.
Each competition jury is carefully chosen by Archiol Competitions to best represent a valid and fair opinion for each project. Competition jury may change during the competition and stated jury members are not guaranteed to participate as final judges. Competition entries will never be judged with participant information as an influence, submissions are judged solely on submitted work. Jury decisions are final and may not be argued by participants. No requests to conduct a revision of the results would be entertained under any circumstance.
Failure to provide the requested work affiliated with each competition may result in disqualification. For any questions regarding what is required, contact Archiol Competitions for clarification.
If files submitted for a competition are not correct or do not adhere to the submission guidelines as determined by Archiol Competitions team, Archiol Competitions is not responsible for getting the files to the jury and the entries may be disqualified from the competition.
Once registration is completed no refunds prior to or after the competition’s deadline will be granted. All registration payments are final.
Competition awards of any manner are subject to change throughout the competition. Additional awards may be added; awards may be subtracted or altered at any time. It is the participant’s responsibility to regularly check the website and be aware of any changes.
Archiol Competitions may publish submitted work on the Archiol Competitions Website, social media, third-party platforms and other media in accordance with the publication and commercial-use licence contained in these Terms and Conditions. Archiol Competitions aims to publish competition work on as many platforms as possible, individuals and teams agree to these publications upon submission.
Archiol Competitions reserves the right to dictate method of payment, whether physical, electronic or to be accepted by a specific platform(Such as Paypal, Stripe, PayUMoney, Razorpay, etc.).
Archiol Competitions is in no way liable for the designs submitted by participants and teams. It is the responsibility of the participants to create original work.
Winners and finalists of a competition on Archiol Competitions agree that they will participate in any interviews or publicity matter upon reasonable request.
Archiol Competitions is not responsible for any in-person site analysis and research. Archiol Competitions does not own the sites on which the competitions are held and therefore participants must abide to any local private property details and relevant law.
Members and/or representatives of Archiol Competitions or their family members or anyone else connected in any way with the competition or helping to set up the competition shall not be permitted to enter the competition. They are however, encouraged to submit ideas for a special mention but cannot win or be part of the formal competition.
Closing date for entry will be on the time and date set on the competition announcement. After this date no further entries to the competition will be permitted. Archiol Competitions will not accept any responsibility for entries not received within the permitted time, for whatever reason.
Archiol Competitions reserves the right to cancel or amend the competition and these terms and conditions without notice, at any time they see fit. Any changes to the competition will be notified to participants as soon as possible by the organizer.
Archiol Competitions is not responsible for inaccurate prize details supplied to any participant by any third party connected with this competition.
Winners will be chosen by an independent panel of judges appointed by Archiol Competitions.
Archiol Competitions’s decision in respect of all matters to do with the competition will be final and no correspondence will be entered into.
Participants may choose to subscribe to newsletters and promotional communications from Archiol Competitions. Marketing communications may be unsubscribed from at any time using the applicable unsubscribe mechanism.
ORGANISATION AND ADMINISTRATION
Architecture and Design Competitions on archiolcompetitions.com are organised and administered by Archiol.
Archiol competitions reserves its right to assign any judges, agents or other authorised administrator to administer it’s competitions, including making any decision or exercising such at its discretion.
ELIGIBILITY
By entering Archiol competitions, any and all Participants, participants, and submissions agree in full to these Terms and Conditions and as referred in this document.
Archiol competitions competitions are open to anyone aged 18 and over. Younger Participants or group of students under 18 years of age must be lead by someone aged 18 or their tutor 18 or over.
Please read these terms and conditions carefully prior to entry to ensure that you understand and agree. You agree that submission of an entry in the Competition constitutes agreement to these Rules.
You must agree to these terms and conditions prior to submitting an entry to the Competition, in order to be eligible to receive the prizes described in these Rules. These Rules form a binding legal agreement between you and Organizer with respect to the Competition. You must have access to the Internet and a valid email address in order to enter the Competition.
SUBMISSION
Participants may either make a submission individually or as a team (4 people max.).
Participants may not sell, assign or transfer ownership of the copyright in their Submission to a third party in a manner that prevents Archiol Competitions from exercising the rights already granted to Archiol Competitions under these Terms.
Nothing in this clause prevents the Participant from licensing or otherwise using their own work, provided that such use does not revoke, restrict or interfere with the rights already granted to Archiol Competitions.
Student Participants would be required to proof their status for any student only competitions and the same would be true for professional only competitions should the submission be selected as one of the winning Participants.
All Submission must strictly conform to any Terms and Conditions and the Rules and Guidelines set by our Archiol competitions Competition Brief.
Once the final submissions are sent, no additional edits, or change can be made. Upon sent of the final submission each participant will receive a confirmation email notification within five business days.
By entering the Competition, the Participant acknowledges and accepts that the narrative, description, details, drawings, images, illustrations, photographs, renderings, animations and other materials forming part of the Submission may be reproduced, published, displayed, distributed, archived, promoted and otherwise used by Archiol Competitions in accordance with the publication and commercial-use licence set out in these Terms.
PERSONAL INFORMATION
Archiol competitions will only use any of the personal information submitted by Participants or participants where necessary, disclosed to third parties for the purposes of running the Competition.
OWNERSHIP AND COPYRIGHT
The ownership of copyright in all Submissions remains with the applicable author or other lawful copyright owner, subject to the licence granted to Archiol Competitions under these Terms and Conditions and the Copyright Act, 1957, as amended from time to time. Except for prizes or other compensation expressly stated in the applicable Competition rules, Participants shall not be entitled to payment, royalties, revenue share or other compensation for submitting a Submission or for granting Archiol Competitions the rights and licence described in these Terms, including where Archiol Competitions uses the Submission in publications or products that are sold, licensed, offered by subscription or otherwise commercially distributed.
Subject to any limitation herein, any design, drawings accompanying any entry or submission remains the property of the Participant and may be used for its or their own purpose. Archiol competitions shall treat an entry or submission as being eligible to enter the Competition under Indian Copyright law.
By entering the Competition, Participants agree that their Submission may be included in publications, collections and compilations created by Archiol Competitions, including publications organized by Competition, theme, subject, category, year, architectural or design topic, or other editorial criteria.
Participants are solely responsible for protecting the intellectual property of any submission to Archiol competitions.
COMPETITION DISQUALIFICATION
Submissions which do not meet or comply with the submission guidelines or found to contain identifying sign or mark that may, in any way, contribute to identifying participant shall be disqualified and Archiol Competitions shall be under no obligation to notify the Participant /s of the disqualified entry or submission. All Submissions after the closing date for a particular competition will be automatically disqualified.
COMPETITION CANCELLATION/WITHDRAWAL
Archiol competitions reserves the right to cancel or suspend or alter the rules at any stage, if deemed necessary in its opinion, and if circumstances arise outside of its control.
Archiol Competitions reserves the exclusive right to cancel any competition in the event that the total number of registrations received for such competition is fewer than twenty (20). In the occurrence of such cancellation, all registered participants shall be duly notified, and any registration fees paid shall be refunded in full to the participants. Archiol Competitions shall not be held liable for any indirect, incidental, consequential, or special damages, losses, or claims arising from or related to the cancellation of a competition due to insufficient registrations.
COMPENSATION
Any Compensation will be handled by Archiol competitions
TERMS FOR JURY
The members of the jury panel are eminent industry professionals selected by Archiol Competitions to evaluate the competition entries. The Members of the panel belong to diverse backgrounds and represent different design perspectives and skillsets. All the competition participants are prohibited to make any form of contact with any juror during the course of the competition. In any circumstance found to disturb the privacy or integrity of the jury Panel Archiol Competitions reserves the right to disqualify the participants from the competition or event and prohibiting them to participate in any future activities undertaken by Archiol Competitions. All the jury members are committed to the cause of the competition however this does not guarantee their participation in the final event of the jury. All the judgments made by the members of the jury panel cannot undergo any form of questioning and under any circumstance. The participants are recommended to submit their work in appropriate formats requested by Archiol Competitions in case the works or submissions are not in accordance or do not adhere the rules specified or does not open under any circumstance Archiol Competitions reserves rights to disqualify the submissions without any clarification.
WINNER SELECTION/JUDGE’S DECISION
Archiol competitions’s determination of any winning entry or submission through its panel of judges is final.
In the event that a selected winning entry cannot accept, receive or ineligible for the prize for any reason, the prize shall be awarded to the next highest rated entry from the top shortlisted or remaining entries that meet the winning requirement.
Archiol competitions’s is association with the competition judges do not imply any legal association, affiliation, contract or partnership in any way shape or form.
PUBLICATION AND COMMERCIAL USE
Archiol Competitions may publish, reproduce, distribute, display, archive and otherwise use submitted work in accordance with the licence granted under these Terms.
This includes publication on the Archiol Competitions website, social media, third-party websites and platforms, exhibitions, magazines, books, catalogues, e-books, PDFs, digital publications, printed publications and other physical or electronic media.
Archiol Competitions may offer publications containing submitted work free of charge or for sale, subscription, licensing or other commercial distribution, without further permission from or payment to the Participant, subject to the rights and licence granted under these Terms.
COMPETITION INTEGRITY
Archiol competitions undertakes to scrupulously protect the integrity of its competitions by : –
A Unique Participant Registration Number by which each submission received will be administered organized, processed and evaluated. This means that the digital board received will be stored under their registration numbers, with the complementary information kept in a separate file.
Enforcing the rules that besides the registration number, all illustrations or images accompanying any submission shall be devoid of any marks, logos, symbols or sign that may identify its authority or source.
Any infringement of these rules will lead to immediate disqualification.
The jury or judging panel will only be made of the Participants identities only after the evaluation stage and winners are selected. Inviting professional jury and providing a jury report.
PRIZES
Prizes awarded will be as advertised for each competition; however Archiol Competitions reserves the right to add, reduce or alter prizes.
The award of cash prizes is subject to the minimum number of eligible registrations specified for the relevant Competition. The applicable minimum registration threshold may be stated on the Competition webpage, Competition brief, registration page or other official Competition information published by Archiol Competitions.
If the number of eligible registrations received for a Competition is below the applicable minimum registration threshold, Archiol Competitions reserves the right not to award the advertised cash prizes, even if the Competition proceeds and the entries are evaluated by the jury.
In such circumstances, Archiol Competitions may, at its discretion, provide alternative recognition, awards or benefits to Participants, or may modify the prize structure. Participants acknowledge that registration for a Competition does not guarantee the payment of an advertised cash prize where the applicable minimum registration threshold has not been reached.
Where a Competition is cancelled pursuant to Clause 235 due to insufficient registrations, the cancellation and refund provisions of that clause shall apply.
Except where a Competition is cancelled and a refund is expressly provided under these Terms, the failure to reach the minimum registration threshold for cash prizes does not by itself entitle Participants to a refund of their registration fee.
Documentary evidence of the architect’s or team leader’s right to practice the profession their respective country or country of residence may be required before any awards payment is made to a recipient.
Photographic identity document such as passport will need to be provided to Archiol Competitions before any award payment will be made.
In the case of a studio or company, then the formal company registration documents will need to be supplied together with photographic identification of director or team leader.
All Bank account details into which any prize money is to be paid must match that of the registered individual or team leader.
If the winner chooses not to accept the prize, an alternate winner will be chosen.
All federal, state, and local taxes on the value of the prize are the sole responsibility of the winner.
Failure to return of any prize notification requested detail within the deadline may result in forfeiture of the prize. Any winner or potential who cannot be contacted within two weeks of attempted first notification may result in disqualification and forfeiture of the prize.
REGISTRATION FEE AND NO RETURN/REFUND POLICY
There is a registration fee for Competitions on the website and all costs and disbursements incurred by participants in preparing a submission or entry are the sole responsibility of the participant. All registration or submission fees are non-refundable and non-transferable once an entry is made.
GOVERNANCE
These rules of Archiol competitions Competitions are governed by the laws of India. By participating in this Competition, you agree to be bound by the terms and conditions of the third-party resource links or specific products.
PUBLICITY AND PROMOTION
Winners agree to and shall upon request at reasonable notice, participate in : –
Publicity or promotional activity surrounding the Competition such as interviews, personally or otherwise. Each opportunity shall be taken on merit and the Participant or participant, shall have the right to decline any such opportunity.
Any imposed government regulations or economic sanctions by India that prohibit monetary transfer to a Winner’s country of residence shall result in the prize money shall not be awarded to the Participant and at Archiol competitionss discretion may award it to the next highest ranked entry, however will mention the original winning entry in its list of winners.
LICENSE
The rights granted to Archiol Competitions in relation to Submissions are set out in the “Commercial Publication & Content Licence” and “Publication and Commercial Use” sections of these Terms and Conditions. Those provisions govern Archiol Competitions’ rights to reproduce, publish, distribute, display, archive, promote, license and commercially distribute Submissions.
COMMERCIAL PUBLICATION & CONTENT LICENCE
In addition to the rights granted elsewhere in these Terms and Conditions, by submitting any entry, project, design, drawing, image, photograph, rendering, animation, text, description, presentation, document or other material (collectively, the “Submission”) to Archiol Competitions, the Participant grants Archiol Competitions a non-exclusive, worldwide, royalty-free, transferable and sublicensable licence to reproduce, publish, distribute, communicate to the public, display, archive, format, edit, crop, resize, translate, adapt and otherwise use the Submission, in whole or in part, in connection with Archiol Competitions and its publishing, editorial, educational, promotional and commercial activities.
This licence expressly includes the right of Archiol Competitions to:
include the Submission, in whole or in part, in printed books, magazines, catalogues, journals, annual publications, competition publications, collections, compilations and other physical publications;
include the Submission, in whole or in part, in electronic books, e-books, PDFs, digital magazines, downloadable publications, online publications, digital catalogues, databases and other digital or electronic publications;
create, publish, distribute, market, promote, license and sell such publications, whether individually, by subscription, as part of a collection, or together with other submissions or materials;
combine the Submission with submissions made by other participants for the purpose of creating curated publications, collections, compilations, books, catalogues, magazines or other publications;
use reasonable extracts, images, excerpts, previews and representations of the Submission for the advertising, marketing and promotion of any such publication or Archiol Competitions generally;
reproduce the Submission in different formats, resolutions, sizes, layouts and file formats as reasonably required for publication, distribution, advertising, archiving or technical purposes;
translate or adapt text contained in the Submission into other languages or formats where reasonably required for publication or promotion;
make the Submission available to Archiol Competitions’ service providers, publishers, printers, distributors, hosting providers, digital platforms, retailers, marketing partners and other contractors to the extent reasonably necessary to exercise the rights granted under this section; and
continue to exercise these rights in relation to publications that have already been created, distributed or sold, even if the Submission is subsequently removed from the Archiol Competitions website, subject always to applicable law.
The Participant retains ownership of the copyright and other intellectual property rights in the Submission, except for the licence expressly granted to Archiol Competitions under these Terms and Conditions. Nothing in this section transfers ownership of the Participant’s copyright to Archiol Competitions.
COMMERCIAL NATURE OF PUBLICATIONS
The Participant acknowledges and agrees that Archiol Competitions may use the Submission in publications and products that are offered free of charge or made available for purchase, subscription, licensing or other commercial distribution. The Participant shall not be entitled to any royalty, fee, revenue share or other compensation arising from the exercise of the licence granted under this section, unless Archiol Competitions expressly agrees otherwise in writing.
AUTHOR AND PROJECT CREDIT
Archiol Competitions will make commercially reasonable efforts to identify the Participant, author, designer, architect, studio or team using the name and other credit information supplied with the Submission. The format and placement of credits may vary depending on the publication, platform or medium.
PARTICIPANT’S RIGHTS REPRESENTATION
By submitting a Submission, the Participant represents and warrants that:
(a) the Participant owns the Submission or has obtained all necessary rights, licences and permissions required to submit the Submission to Archiol Competitions and to grant the rights set out in these Terms and Conditions;
(b) the Submission does not knowingly infringe the copyright, trademark, design rights, privacy rights, publicity rights or other rights of any third party;
(c) where the Submission contains photographs, illustrations, artwork, text, graphics, fonts, music, video, renders, images or other materials created or owned by third parties, the Participant has obtained all permissions necessary for Archiol Competitions to exercise the rights granted under these Terms and Conditions; and
(d) the Participant has the authority to grant the licence described in this section on behalf of all members of the submitting team, where the Submission is made by or on behalf of a team, studio, company or other organisation.
The Participant agrees to provide reasonable evidence of such rights or permissions if requested by Archiol Competitions.
PUBLICATION WITHOUT FURTHER CONSENT
The Participant acknowledges that the rights granted under this section are granted at the time of submission and that Archiol Competitions is not required to obtain additional permission, consent or approval from the Participant each time the Submission is reproduced, published, distributed, displayed or included in a publication or product falling within the scope of this licence.
NO GUARANTEE OF PUBLICATION
Nothing in these Terms and Conditions obliges Archiol Competitions to publish, distribute, sell or otherwise use any Submission. Archiol Competitions retains sole discretion as to whether, when, where, and in what format a Submission is published or used.
TERMINATION
Archiol Competitions may suspend or terminate a Participant’s account or participation where the Participant breaches these Terms and Conditions, applicable Competition rules or applicable law.
Termination of an account or participation does not automatically terminate or revoke any licence previously granted to Archiol Competitions in respect of a Submission, except where required by applicable law or expressly agreed otherwise in writing.
Where a Submission has already been incorporated into a publication or other material before termination or withdrawal, Archiol Competitions may continue to distribute, sell, display, promote and archive that existing publication or material.
AMENDMENTS
Archiol Competitions may amend these Terms and Conditions from time to time. Updated Terms will be published on the Website. Changes that materially affect rights or obligations relating to future Submissions will apply to Submissions made after the updated Terms become effective, unless otherwise permitted by applicable law. The version of these Terms accepted by a Participant at the time of Submission will continue to govern the rights and obligations arising from that Submission, unless the Participant expressly agrees to a subsequent amendment.
